Crossing the Border back to Canada after a while (been in USA since end of Sept.)?

Hi, I'm trying to get back home and I'm wanting to know if I can go home without any resistance. I'm canadian, I've been to the USA before and returned without a hitch after a 6 month visit.

I've been here far too long already (since the end of november), my situation is quite bizaree and its besides the point.

I have means to get home PRONTO as I've got a ride from a friend, my girlfriend would like me to come with me.

I'd entered from Land and would like to return, though I'd also like to know if any problems may occur while crossing the border back home.

I really need a solid answer, and hope that I will not get arrested at the border. That is my main fear!

So please help me!

  1. You keep asking variants of the same question.  You violated the law by overstaying.  Go home!  The faster you leave, the less trouble you'll be in.  If you get caught here, you go to immigration detention until you are deported.  If you get to the border, they will note your overstay and you will be barred from re-entry, but you are not likely to be arrested unless there is a warrant for your arrest on other (non-immigration)charges.  So go home just as fast as you can.


  2. If you have a valid canadian passport then you are a returning canadian so you should not have any problems getting into Canada.

    However if you did overstay in USA, then you MAY be banned from entering the USA for a few months or up to 10 years.

  3. When I go back home, Italy, they don't ask me for any kind of passport or visa like when U come back, they don't really care if U legal or not, since UR leaving already, so no they can't arrest U.
