Custody if my wife gave me full custody of our baby is that legal?

if my wife writes and signs a letter saying that she gives full custody of my baby to me will that hold in court or is that a legal document that would give me full custody in case of a divorce

It would help you out, but you would still have to go to court. If she tried to fight for custody, you could use that letter to help you with your case.

Of course, if she signed it under duress, it wont hold up... meaning, if you held a gun to her head to have her write it out, or something like that, it wont hold up. But, if she willing does this, then I would ask her to go with you and get it notarized.

No.  It will hold about as much weight in court as the ink it's written with.  If you're going to do this, you need to do it the right way.  Hire an attorney and have the documents written.  Sign them and have her sign since she is willing, then get the custody papers filed and signed by a judge.  Then it will be legal.

It's not legal, a court has to rule on it. It's for your own protection as well as hers and the baby's. If you really want custody, think of it as insurance against your ex-wife suddenly changing her mind and wanting to take the baby. She would have to go through the courts, she couldn't just take the infant from you.

in a divorce, what ever you want & agree on the judge will give.

You should still file it through the court just to be on the safe side. All you have to do is take that paper to the court and have them file it. She will receive a letter and so will you. That way your wife can't come whenever she wants to take the baby back.  Good luck and Congratulations.
