Custody issue of little brother living with his father?

I would like to have shared custody of my little brother who lives with my ex-stepfather on behalf of my mother. My mother has no legal custody due to some hardships in the past. But the father has bought my little brother over to her house every weekend since they divorced about 8 years ago. That changed when my ex- stepfather found a new girlfriend and is now getting married again. My mother and almost all of the step father's family believe that the living situation for my little brother is unsuitable being as he doesnt get to see our mother like he should. My mother went almost of two months without seeing my brother and my mother still doesnt know the correct address where they live. Since my mother is going through some financial hardships and has had trouble in the past with custody issues how likely would it be that I, his older sister could get split custody of him?

Well considering he is only the step father if he has not adopted your brother it is likely you can get full custody providing you have stable job house or apartment with 2 bedrooms and can prove to the court why you are more Suitable for the raising of you brother you need to contact a lawyer who can help you in what steps you need to take call a few and get allot of advice before you choose one good luck and hope it works out for you and your family
