Custody of a child question.

my aunt kicked my cousin out and she had to go live with her father. her father tried to get custody of her so he didn't have to pay child support anymore. but the mother still wanted the money so they went to court. my cousin wanted to testify because she wanted to stay with her father. when court started the judge said hurry up i have a big case in couple of minutes. after the opening statements he said that everything should stay the same way it was. my cousin would live with her mom and her father would still pay custody. they didn't even let my cousin testify. is this legal? could my uncle go to court again for this or does double jeopardy include this to?

  1. your cousin can appeal against the judges decision and get to court that way best to go to a lawyer and ask him in criminal trials you can appeal against the conviction or the lenghth of a sentence im not sure about custody hearings go see a brief


  2. it depends how old ur cousin is if he is getting kicked out then he may be in his teens if so he has a right to testify i think its illegal i don't the judge was doing his job well?

  3. This is an issues for both parents to do to settle in the courts for custody and visitation of the child..if solely up to the parents to resolve unless they decide to involve a family member into their business

  4. He can take her back to court.  He will have to file for a Motion to Change Custody and a Motion to Modify Court Order.  This will cost him an initial court fee of about $100.
