Custody of my step son....we have had 3 days a week and Mom wants less after two years.....

My boyfriends son has been with us three days a week since January 2007. We keep records of when we have him every week. Now his ex has petitioned the court for us to only get him every other weekend. Not to mention my bf pays almost $400 a month for child support and she uses it for whatever because she is unemployed. Have had problems with her calling because she ran out of diapers before or because she had no food and we helped her out. We want joint custody, we also have a daughter together and plan to marry. What are the chances of the court deciding that joint legal and physical custody would be basically what we have already had?

It sounds like you have a very good chance.  You can request through your attorney a GAL for your step son.  This is his own lawyer that will look out for his best interest.  What the GAL suggests to the court will weigh heavy on the judges decision.  Best of luck.
