Question:

D.S.S Have my two children how do I fight them?

I had contact with drugs i tested positive when i gave birth to my daughter. I did not use them tho i got second hand. D.S.S have had my kids for two months and still have not given me a service plan. I am not a drug Addict and I do not abuse drugs. I have been doing everything i can to prove myself but they are not impressed at all. I even went to an intensive outpatient drug and mental health program to get evaluated and they did not recomend drug counceling. They did not think that I have any substance abuse problems. I am a cna and the person I was caring for is a drug addict so every time he does drugs it gets into my system I was not even thinking about that or anything like this could ever happen to me. I stopped going to the home of my client. I offered to do random drug testing with my pcp, I'm even voluntarily attending parenting classes. None of these things are impressing D.S.S I do not know what else to do. There is no sign that they are going to release my kids soon.

  1. sounds like they have a few unresolved issues pending if they are not working on returning your children, Also they might be seeing if you will press the issue and do what ever it takes to get your children back.

    definitely get an attorney, State agencies don't feel they have to give you the time of day but they know attorneys know the laws and have means to get things done,

  2. Is your home spotlessly clean? Does anyone else have a key to your home, other than yourself and your children? Do you keep any other adult who might use drugs out of your home at ALL times? Is your home quiet at night so your children can get a proper amount of rest before school? Do you ensure that your kids go to school and never miss a day unless they are seriously ill? Do you provide a calm atmosphere for your children to do their homework? Would a person from DSS walk into your home right now and say, "Wow, this is a calm, nurturing, SAFE environment for a child"? What would your neighbors say about your character, the people you socialize with, the amount of time you spend with your children, your lifestyle, the kinds of people that come into your home, etc.?

    These are all questions you need to ask yourself -- perhaps DSS doesn't believe you are providing the right environment for your child, and your neighbors might agree with that. If you want to change opinions, you need to exude responsibility, competence and stability as a parent.

  3. get a lawyer and stay away from drup addicts....I don't understand how you could test positive it you were not using?  if you used drugs while pregnant you have a serious problem...it could not be casual...

    don't give up...but your story doesn't sound right....

    they may want you to take responsibility.....

  4. first never fight your two children, oops the grammar teacher behind me just explained you meant how do you fight the DSS? sorry, about your kids.  hope you get them back soon.

    the ex kicked me out and i rarely see the kids anymore so i know how you feel.  hope you atleast get to visit them.
