D.u.i. checkpoint - saftey belt violation... whats gonna happen to me?

hey everyone i have a question.

im 17, will be 18 in 9 days, right?

well me, and my 3 friends were in a 63 ranchero, which sits 3, but we had four in there.

i was wearing a seat belt when we got to the thing, but the thing is, they didnt check me. they asked how many seat belts there were, and how many were in the car?

so basically they said its saftey belt violation. i gotta go to traffic court in 2 months. i asked if this is going on my record or something and he said no? then i asked is this gonna cost like 500 bucks, he said no, not more than 35 bucks.

so whats gonna happen, am i really gonna get a point on my liscnese or something, or pay 500 dollars or not? im scared.

...make a phone call to the Clerk of the Court that has the jurisdiction of the violation and "ask"...  it's that simple... no one will "bite" you...

You will be fine, just a small fine and butt chewing from the judge but don't let it happen again and drive safe.

The campaign here for a seat belt violation is "Click it, or ticket".

Sounds typical.  You probably have nothing to worry about.  Just go online and check your state's seatbelt laws.

sounds like you may have to sit through one of those "driver's ed" classes and that may be it (after the fine).

Usually those will go on your record, and you take that class to get it off or they just won't put it on there.

But you may luck up and just have to pay the fine. Be sure to allow all day for the court date, those take FOREVER to go through because there are so many people there.

But you won't have to pay 500 bucks. It'll be less than 50 is my guess.

give it a rest...it's no points (points for driving violations only) and it's a small fine $50 or less.

They're just gonna tell you, don't pack so many people in a vehicle that wasn't meant to hold that many...

i got the same **** for hanging out of the sun roof of a limo. they gave me a seat belt ticket but there was about 7 or 8 of us in the limo and with only 3 seatbelts on the back bench i took it to court and got let off because there is not enough seatbelt. The funny thing is the weekend after i look at my city newspaper im from canada and the priminister is out the limo sunroof  with cops on bikes all around him like he really got a ticket.

It's not that big of a deal. You'll get a small fine. That's all.

No it is a no point violation which means it is a Non Moving Violation.

Also the vehicle is a classic vehicle and the requirements for safety standards for that Vehicle were different so You should be able to have the case dismissed based on the year of the Vehicle.

Tell the Judge This

Show him the registration and or a cirtified copy of the title.

Then take Pictures of the Seat Belts and seating configuration of the Vehicle. and Tell the judge this.

in the pre trial motion the judge will ask you before any thing else how do you plead.

You Say: Your Honor I would like to request a dismissil of the case based on the year that the Vehicle was manufactured.

and that any changes to the Vehicle would hence decrease the value of the vehicle on an historical value. and in 1963 the year the vehicle was manufactured it was built to standard safety guidelines for that year. (DO NOT MENTION YOU HAD 3 PASSANGERS) and if that third passanger was not interfearing with your driving the car safely then you should be ok.

Now here is the trick. Bring only the two freinds you trust most with you to court that were in the car as witneses.

and if the judge denies you the pretrial motion then you plead not guilty and say you only had two freinds and the cop must prove beyond a resonable doupt ( HE TOOK A PHOTO ) of 4 in the car and you have two witnesses that will state that you were the only three you should win.

Now If you are in Kern County California Your Screwd and might aswell Pay the Ticket but again it is a non moving violation
