!!! DID I DO THE RIGHT THING? MINOR CAR accidient-what CAN I DO NOW? HELP??!!!!!!! don't know what to do?

Ok...well i was driving today on the righ lane, and then i signaled for the left and out of nowhere , this car comes and hits me in the back but he put on his breaks but he still hit me for some reason. WE pulled to the side. It was no major damage. Just paint job body work. Thats about it. He said i don't want to get you into alot of trouble because you are 19 and i understand life and stuff. I was like ok. He said the only thing we gotta do is just call our inusrance company. But the thing is i don't know who's fault iz it. I mean It may be my fault because i shoulda checked the lane but it could be his because he shouldve saw what car was coming in the lane. Also he was lisneting to music and smoking a ciggerate so i don't know. But whats gonna happen? Am i dead meat or something . am i in alot of trouble because i'am scared? Will my insurace go high . If it does, what can i do to make it not go. Please help me on what to do

  1. The adjuster to your insurance claim will tell you who is at fault. Just tell the truth.


  2. 99% of the time, if you are hit from the rear its not your fault. At least in missouri. But for future reference, ALWAYS call the police in any traffic accident, chances are he was probably driving with out insurance or on a suspended liesence if he was not wanting to call the police. If some one cut me off (which is preaty much what you did, even though you checked your self before signaling) I would call the police. Chances are nothing much will happen, unless he trys to say now he was wiplash or somthing.. but I doubt it.

  5. if he hit you in the back side  its his  but if its the side of then its yours and you should have call the cops if you plan on turnning it in to the insurance that wil be the first thing they ask you  for and then it will be his name and what kind of car and his plate number

  6. When in an accident NEVER say "it was my fault."  The

    insurance companies will duke it out for liability.  You will most

    likely win in this case since he rear-ended you.  If you can

    also show that he wasn't paying attention (yakking on the

    phone, playing with his stereo, etc) it strengthens your posi-

    tion.  When you talk to your agent, don't say what you failed to

    do unless it answers a specific question.  Do say what you

    know for sure (I saw him in my mirror reaching toward the

    radio, etc.)  It shows that you were aware of details.

  7. You should have called the police. If you pulled into the lane without Looking first, of course it was your fault.But you will not say so. He may have been speeding at 80 or something. The police would have checked the skid marks and determined how fast he was going. As you say, he hit his brakes before hitting you. Now you have the possibility of him turning it in as a hit and run. If he does not bring you into it, and tells his Insurance Co. that someone backed into him in a parking lot, then you are ok. If he turns it in to the insurance, and you don't, you may have a problem. So if you have his phone number, call him and see what his intentions are.You may be better served to call your Insurance Co and tell them about the accident. Most times they will not raise you Insurance. If you have a number of accidents, then they have been known to, or cancel you all together. Good luck.

  8. It sure sounds like you are guilty of failing to change lanes in safety.  Have you no mirrors?  Did you not check your blind spot?

  10. The car wasn't out of nowhere. You just didn't look. It may be your fault for not looking, but he'll probably get the fines and stuff.  Your insurance will go up whether it was his fault or yours.

    I wish the law would recognize it as your fault, because it was. I really hate it when people cut me off.

  11. if you managed to make it to the center of the lane and if he hit you after that it's his fault! in romania not giving prioriy to another driver will get your driver's license suspended!

  12. Normally, anytime a vehicle is hit from behind the fault is ussually placed an the driver behind.  but you just admitted that you changed lanes without looking "I mean it may be my fault because I shoulda checked the lane"

  13. more or less its going to be the persons fault that hit you. most reaerendings are the rear enders fault. just b honest.
