DO YOU HAVE TO PAY MEDICARE SSET ASIDES IN A LAWSUIT THAT IS NOT A WORKMEN'S COMP CASE?

WE ARE GETTING READY SETTLE AFTER 2 YEARS OF BATTLING THE DEFENDANTS INA SUIT THAT HAS LEFT MY HUSBAND WITH A TERMINAL NON-REVERSABLE DISEASE. IT HAS NEVER BEEN A WC CASE. NOW 2 MONTHS AGO MY HUSBAND WAS TOLD BY HIS ATTORNEY THAT IT WOULD AFTER MEDIATION THAT DEFENDANTS WOULD PAY HIM 1 MIL AND THEN WC WOULD PAY HIM ALSO .BUT HE WOULD HAVE TO FILE A WC CLAIM. WE JUST DID THIS. NOW THE ATTORNEYS RUSHED US TO SIGN NEGOTIATING PAPERS AND THAT WAS THE FIRST TIME WE HEARD ABOUT MSA AND THE CMS AND ALL. WE TOLD THEM TO WITHDRAW THE NEWLY FILES WC CASE NOW THEY ARE BEING RUDE AND NOW THEY ARE SAYING THEIR ARE PROBLEMS WITH THE ACTUAL CASE? SOMEONE PLEASE HELP WITH THIS QUESTION BECAUSE IT SEEMS THAT THE ONLY ONES THAT ARE GOING TO BENEFIT ARE THE ATRORENYS ON BOTH SIDES. I CALL THE "COB" & THEY TOLD ME THAT THIERE ARE NO ST ASIDES ON A NON-WORKMEN'S COMP CASE I JUST NEED TO BE INFORMED BEFORE WE MEET WITH THESE ATTORNEYS AGAINS.

  1. I have never heard of having to pay medicare taxes on a settlement.  I know you have to pay Federal and State income tax.

    In a lot of lawsuits the people that win the most are the lawyers :(
