DUI can you move out of state when you have a Court date for a DUI and have someone represent you in court? ?

I'm asking this on be half of my Brother he has a DUI in Hawaii he's wants to move to New York for a Job now. Can he Move and have someone represent him in Court? He went to court once and the Judge said he need a public defender and gave him a nother court date for November.

  1. No, he cannot. Criminal defendants are required to be present during hearing on the matter.


  2. he should talk with an attorney about this....generally a change of venue will not be granted for this....he will have to abide by whatever hawaii state law is for his punishment which may vary from new york...once he goes to court and is placed on probation then he can have his probation switched to new york....if he can return for his court date to hawaii then he can go to new york to set up house....so long as he is in front of the judge in hawaii at the time and date he is supposed to he should be fine

  3. He must show up for court.  He cannot have someone represent him.

  4. Unfortunately if he chooses to allow the public defender represent him, he will have to be present. His best option, if he has the funds, is to hire a DUI/DWI attorney. The public defender will only have him plead guilty to the case while an attorney can (and will) get the charges reduced without your brother having to set foot in court.
