ok a friend of my husbands was leavin a club or something and got into a car accident and he was issued a DUI cuz he was on the border line of being too drunk to drive anyways now his insurance wont cover the car accident. is this right and legal because of the DUI (1st offence no tickets) or is it kinda weird

  1. I'm pretty sure once you they see you have been drinking they won't cover you. Even if it is a 1st offense.


  2. If he was borderline, he may try to dispute the claim. If he has a lawyer for the DUI, it might be easier to dispute the insurance claims on test accuracy, impairment, etc., especially if there has not been a conviction or plea yet.

  3. California, along with 36 other states, have some form of Alcohol Exclusion Laws which allow insurance companies to deny claims (medical, auto, etc) due to alcohol related accidents and injuries.

    This is unfortunate, and maybe your husband's friend can appeal it with his insurance company and work something out to save him a lot of money out of pocket.
