Dad was in accident now we need advice!!??

Ok my dad was in a life threatening accident he's back home now but he can't movie his arm up that much it hurts him badlly beofre the accident he already had a bad back now it may be worse he was a truck driver and the owner of the buisness we are pretty sur ehe doesn't have Workmens Comp and now my dad will probaly get stuck with all f the hospital bills and he will get nothing out of it when it could of killed him! THe load was also over sized! We don't have alot of money and we need to get a good lawyer (In Illinois please!) becuase I don't think he can legally not have Workmens Comp then file bankruptsy....I mean wouldn't that be faulty justice or something like that? We hired then fired Ronald Holiday...now we have another lawyer who says he can't do anyhting aobut it....please help us!!

  1. aw im sorry, i also live in illinois and im 15, i would go to lawyers and sue,and about the hospital stuff you can go to a hospital and get whatever checked out. IF you dont have insurance im sure there will be a diff way

    ** i just edited this i didnt no he owned it, that lessens chances, but does he offer insurance to other workers? because u never know they might need it and they can sue if something happened to them


  2. If he was the owner, he would not qualify for normal WC coverage.

  4. You file for Workmen's Comp benefits with the state, usually the Labor Department or the Workforce Commission or something like that.  They will ascertain whether the employer had coverage and take the appropriate action if the employer did not.

  5. youll have to talk to different lawyers personally. If your father commited faulty justice or whatever and lawyers cant do anything then they really cant do anything.

    But i would talk to some lawyers, tell them you'll set up payment plans for there help. Thats what we were going to do for my dad.

    Thats the only thing i can tell you.

    If your father commited a crime and no lawyer can help him because of it, then i would consider that karma. I fell bad for you though, i know how this buullshitt feels. Just talk with a few different lawyers, see what they have to offer.

  6. Workmans Comp is determined on the volume of business and the number of employees. If money is owed on business, most all lenders require insurance to protect their interests in that business. However if your father was self employed as the driver and furnished his own truck, he then was responsible for his own insurance. Whom was at fault in the accident, again if it were your father's fault, he has no legal right to try suing anyone. if he caused the accident he then is responsible for anyone he hurt or caused a loss. This is called liability. He then can check with Social Security if he has ever paid into it. Also check on Medicaid or Medicare.

  7. Talk to your hospital about indigent care and see what they can come up with to help pay for hospital bills. They should have some papers for your family to fill out and surprisingly our hospital here is wonderful at helping on those things.
