what legal actions I can take against sublet of my roommate. my roommate brought in sublets 2 months back. the guy and her gf have been stealing my food, articles from bedroom, bathroom and also damaging properties. I told them to leave but they are not leaving nor my roommate is taking action. neither did they pay bills. can I call cops on them ? what evidence can I gather ?

  1. state law differers but you can hold your original roommate liable for unpaid bills of the subletors. the food thing is a lost cause.

  2. If you are the sole person on the lease you can have all of them evicted. Contact your landlord and the police. Also check with legal aide in your area. They usually offer free advice.

  3. talk to your landlord about it, he should have the answers.

  4. If your roommate has signed a lease or any type of rental contract, you can take her to small claims court. If her name's on a legal contract of some sort, she is still legally responsible for paying her share of the bills. As for the sublets...have you had them sign anything? If they're not on a lease or anything you can kick them out because technically if someone's not on a lease they aren't supposed to be living there. Documenting what they've stolen wouldn't hurt either. Calling the cops & filing a police report isn't a bad idea either, if they're not paying their share then I would think that you'd be able to kick them out....if worse comes to worse, take their key & set their **** outside and tell them to get it & never come back! Also try having a face-to-face talk with them and tell them to knock it off unless they would like to be homeless! Hope this helps....

  5. First thing you need to do is call your landlord.  Explain to him that your roommate moved in 2 people and that you are not happy about it.  Let him know that if these two are allowed to stay that they each need to pay their share of the rent and that you no longer agree to pay 1/2 of it, only 1/4 until they move out.  Also explain that you do not get along with these two people and feel uncomfortable having to share your living space with them.  Who signed the lease?  If you and your roommate are both on the lease then these two do not belong and your roommate has clearly broken his end of the signed contract.  If all else fails, legal action may be taken.  In which case you would need to get some kind of legal advice.
