Dealer signed two contracts on same vehicle?

I recently put a deposit on a vehicle and later found out that someone had bought it on ebay through buy it now so the dealer sold it to them,why did he sign a contract with me and then do this? can he legally do this

  1. Obviously he cannot sell the same vehicle twice.  Go back to the dealership and have them either sell the car to you or return your money.  Perhaps two different salesmen were handling the same vehicle and one was not aware that the other had sold it.  Either way, it should be fine you may just have to find a different car that you like.


  2. My non-pro belief is you can't sell something you don't own.  If someone sold something on eBay, they don't own it.  That sssumes the technical definition of the sale contract was concluded via eBay.  If it hadn't, any contract he continues with is fraud if he knows he can't deliver on it.

  3. Earliest date on signed contract is the only legal deal.  The other probably has a lawsuit for something, or at least owed a great deal on another vehicle.  Read the fine print on your deposit statement... It may actually allow them to sell the vehicle right out from under you if someone can pay in full.

  4. Hi!! get your contract and goback to dealership. make sure .. that what ever you had it sign .. its dated and read all the concerns, if they tell you your car still here its good,  but if it dose not.. you could do 2 things, one complaining to Consumer dpt and talk to the main persson at the dealer.

    2 you go and get  a lawyer (free ) in court for the small claims   and talke to .. about it. and the rest he is the one to tell what its next jus be careful when ever you sign anything .
