  1. It doesn't happen often, but it does happen.  The creditor will usually give the collection agency/attorney a set time limit to take action and if not, the debt goes back to the creditor.

    I happened with a client of ours - the credit card company took the debt back from the collection attorney - it has been about 4 months now - and nothing further has happened.

    Be mindful of the statute of limitations - it the SOL runs out, you aren't legally responsible for the debt.


  2. It's weird that such a thing would happen..but this can work in your favor. First of all your account is no longer in collections...that in itself is sufficient grounds on which to have a party.

    Secondly you can bring your account current by paying what is overdue.

  3. It would (in my opinion) mean that the attorney could not validate the debt or did not legally have the right to collect.  Some collection agencies pay for the use of an attorneys letterhead just to make it look threatening.

    Ask for validation from the original creditor, if they can not verify the debt as being valid, then they are up the creek without a paddle.

    If the debt can not be validated then send a dispute letter to the CRA's and include copies of all evidence that they could not validate the debt.  The CRA's will then have 30 days to get validation from the creditor, if they do not receive it, then the CRA's will remove it from your credit report as per the FCRA rules  Ã‚§ 611. Procedure in case of disputed accuracy [15 U.S.C. § 1681i]
