Those who know about debt collection

1) I completed a contract (6 month) with a gym but there was a problem quitting (not my fault but irrelevant as ive no proof)and they never cancalled it and continued trying to take money.

2) when the money wouldnt come out of my overdrawn account they handed over the contract to a debt collection agency. who carried on charging me 45 a month and sending letters to an address id moved away from.

3)after ten months the debt collectors phone me and say I owe them 450 pounds as i never cancalled my contract.i n

My questions are

1) If my gym contract states I must continue to pay past the 6 months if i dont cancal. And it also states That they must provide gym membership for said payments. Shouldnt the debt collection agency Legally have to provide gym membership as well as just taking the money from the contract.

2) they say they sent letters but 10 months they had my phone number and didnt call .if theyd called on day 1 i would have pai

  1. Mabye you can settle with your debt collectors company.

  2. keep disputing the charges. I had something similair happen and the collection agency finally gave up.

  3. ok so you have an overdrawn account and you have a membership that you KNOW will be automaticly withdrawn...itsnt this a form of neglect? Why are you trying to argue with the people if YOU agreed to pay. You signed, you owe. Dont get me wrong I dont side with them because thats how they get people....and they have or havent sent letters, you were still knowingly responsible of your monthly debts.

Lets focus on money management will ya?

  4. this happened to me in the UK, a Ballantyne gym, I wrote and told them I was on benefits and offered a token payment of 31 per month which they accepted straight away. this is a standard thing in the UK. I used Payplan, a free debt charity, who gave me this advice and stopped me panicking; you might find an equivalent where you are.
