Defective Product / insurance claim?

Hello-

I purchased plastic containers, and received cuts and a piece of plastic came off and was embedded in my thumb. This resulted in an infection and i was on antibiotics.

The insurace company want to give me $200 for my pain and suffering. -my thumb really did hurt for a month and it was hard to do anyting at all.

Should i settle for this? Is this a good offer?

  1. Which insurance company - your health insurance or the manufacturer of the containers?

    If it's your insurance take it.

    If it's the manufacturer's insurance, calculate and itemize any financial losses that you have taken because of the injury and inability to do work, add in any health care & drug costs, and add $100 for pain & suffering.


  2. First, how did you receive cuts? What were you doing with the plastic containers that caused them to break like this? Were they like that in the package when you went to get them out? These are all questions that you should consider.

    Second, How did the cut turn into an infection? Was it because you didn't treat it right away? If so, why should they pay for something that you could've prevented?

    I guess all of my questions are meant to provoke some thought. Because if some of this was your fault or if it was made worse becuase you didn't do anything about it right away, I would say they're being fair by offering you anything.

    However, if it really was no fault of your own that you got cut and it turned into an infection, I would take the amount of costs you incurred for doctor visits, precriptions, mileage to and from the doctor, etc. and multiply it times 2. That'll be a good starting point.
