Question:

Degreaser spilled in my eye at the Family Dollar and I can't find a lawyer to take my case, can someone help?

I don't have insurance and they don't have medical insurance. I don't have any money for my eye doctor bill and I can't work anymore because of my continuous headache and eye ache. I can hardly see out of my injured eye. Now I got a letter from the Family Dollar claims adjuster to contact her within 10 days (by Aug. 14) or she will assume that there is no claim (yet I have spoken to her before and told her of my problems). I called her and her machine says she'll be out of the office til Aug. 18 and she won't be checking her messages.

  1. I would contact a lawyer and see what they have to say. If your claim is successful, you can be compensated and then sum. How did this happen?


  2. I agree, I would attempt to contact someone else about the matter ... someone higher than the adjuster who contacted you. Also, I would continue to leave messages once a day or more than once a day on her machine proving that you attempted to contact her.

    I would talk to a workman's comp lawyer as well making sure they know whats going on. Tell them about how you don't have much money for the medical bills and can't work because of the injury.

  3. Call her machine back, and record it with a tape recorder. Then use the letter in your case. They are trying to get out of it because they know you have a case.

    Check the Yellow Pages of your nearest major city, and find a lawyer who will represent you at no cost unless you win. There is at least one in every sizable city.

  4. Put a registered/certified letter in the mail today with todays' date on it. Proof you contacted her by the date in question.

  5. I would take it to the next level up. Find someone in higher management than she is in

  6. Any complaint of this nature should be made by registered mail.

    You will probably end up in court and you don't want a "he said, she said" scenario. If you can provide a receipt showing that the complaint was made in a timely manner, by official means, you will be in a much better position to prevail.  

  7. Your case is on thin ice to start with so I'm not surprised you can't find an attorney to take it.

    Family Dollar is a retailer.  They shelve products provided to them.  They would not put out a bottle that's broken or leaking.  It will be difficult to make the case that the firm is negligent, responsible for your having gotten something out of a bottle into your eye, and that they must pay for medical care.

  8. Send her a certified letter.  That way you'll have proof as to when the letter was delivered.  Follow it up with a message on her voicemail.  If she's out of the office, she probably won't be closing your case before the 18th anyway.

  9. If you work there I would probably find a workman's comp lawyer.

  10. Write her a letter with a return receipt before August 14th and get the facts on the table.  They DO have insurance on their company.  Do not let them tell you other so.

  11. The important question is "Were you working there at the time?".

    If you were an employee then you are covered by workers comp, and paying for your medical bills is their liability whether they have insurance or not.

    If you were a customer then the question becomes "Whose fault was it?" If the stuff got in your eye because of their negligence then they are liable. If it wasn't their fault, then they are not liable.
