Did Ex refinance without my signature?

My ex was supposed to refinance the house last month, I am still on the mortgage, insurance, etc. I just called to make sure he's making the payments and his interest rate dropped 1% and he made a payment $300 less. The automated machine doesn't say that anything is late or overdue. So is it possible he actually grew a pair and refinanced so I can get on with my life? He is jobless 95% of the time, so I wonder if his parents helped him.

  1. Sounds like he did. I'd get a lawyer to look into it to protect yourself. Sounds like a case of fraud. It may come to bit you in the behind. My ex pulled a few stunts and nearly cost me dearly. But of course, i talked to the prosecuters office since he had all kinds of felony convictions on his record now and doing some seriuos time for it now.

He can't refinance the existing mortgage without your signature or your power of attorney(legally at least).  If he has no job there's no way he's getting a mortgage, legally.  He doesn't have to refinance the loan to get you off, he can assume the mortgage but it might be tuff if he doesn't work.  When he assumes the mortgage hes taking sole responsibility for the mortgage and your name comes off the loan and title, you will have to sign paper work to authorize that.

    Its sounds like the mortgage he has is adjustable, which is not bad considering most of the adjustable rate mortgages are declining right now(it depends on the Index its tied to).   Man,  its going to suck when that rate jumps up!!
