Did anyone find out that they were being offset but still got rebate check?

Me and my husband just found out that our rebate check is being offset by the Agriculture of food and drug administration and we are being held responsible for something his mom did because they gave her too many foodstamps. I was wondering is there a way that we could still get our money. We called fms and they already said it was applied to the debt. I didnt find out all of this until now but im wondering is it too late to do something about it because we filed jointly. ONly serious answers please.

  1. The only way that you can recover an offset in its entirety is if the agency that triggered the offset reverses it.  

    The reason for the offset doesn't make sense.  Your husband cannot be held responsible if his mother received excess food stamps.

    However whatever the reason for the offset, if it was for a debt of your husband's, you can file Form 8379 to recover YOUR share of any refunds or rebates.  That CAN be filed after the fact so you can recover your share.  Bear in mind that it will take up to 16 weeks to process.
