Did this guy just make an eBay violation?

i just bought "an Education in Rebellion by the union undreground" on eBay. shortly after my purchase the seller refunded me my money an told me they diddnt have it anymore... is this a violation of ebay terms? to sell something you dont own?

  1. No it's not against eBay's terms. If it were, he'd not refund your money and not ship you a copy of the disc.

    It's frustrating though, haha.


  2. No, it's not a violation, just a mistake. As long as he refunded your money, you have no complaint to Ebay. He may have lost it, broken it or sold it at another venue (flea market?). Annoying to you, but not illegal on Ebay.

    As a seller it happened to me once; I sold something (for like $8 or so) and then could not find it anywhere (I refunded the money ASAP) !!! My buyer was very understanding and did not even leave negative feedback. (I did find the item weeks later, it had fallen behind a piece of furniture!)

    If they did refund you all the money, then its not a violation. Sometimes they may have found another buyer in their city to sell it to.
