Didn't file taxes for two years, a friend's hot-shot CPA brother said he would take my case. ?

Now, two years later, with the promise to file an extension the first year, the guy hasn't done anything, hasn't answered my letters, has had someone else take my calls, with the message that as soon as he is through with a current case he will work on mine (this was months ago, and before last April). I would like to try to find someone else, but the man still has two years' worth of my tax records! We are talking four years, now! Any ideas? OK referrals? And don't tell me Fuhr CPA tax business!

  1. Demand your records  back.  You have that right.  If he's really a CPA and doesn't give them to you, then complain to the state CPA association.

    If he said he was going to file for an extension for a return that was already overdue, he's either incompetent or lying - you can't GET an extension for a return that's already way overdue.


  2. I hear this a lot.  The firm I work for gets cases from all over the country from people in your situation.  We only work off of referrals, and get a lot of business from people who have been unsuccessful using other firms.

    The first thing you'll want to do is get your information back.  If he has original records of yours, he is required to give them back upon request.  You can make the request by mail.  Just make sure to save a copy.  Often if a case isn't being worked on, files will get moved into storage, but since yours isn't closed yet, this shouldn't be the case.

    If the request goes unanswered, you could try reporting him to the OK Institute of CPA's (or similar state group), or the Better Business Bureau.

    Depending on the records you gave him, a lot of things can be acquired from the IRS.  Any information, such as W-2's, 1099's, mortgage interest, etc., that is reported to them is kept on file.  You might even be able to get an abatement from some of the penalties and interest for the time lost that this CPA has had your records.

  3. Go to this guy's office and demand your records.  Find someone else to do your taxes.  If you owe, you are going to be subject to penalties and interest for late filing.

    I can't give you a good referral since I have no idea where you live.

  4. ABout all you can do is go to his office and demand your records back. Then go find another CPA that will handle your case.
