  1. what

  2. Guardianship is where you have the child in your home and act as a parent but it is not a permanent situation. You have most rights but not the right to concent to their marraige or adoption.

Custody means you have them under your supervision and care. This term can apply to guardianship, natural or adopted children.

Adoption is a permanent arrangement that gives you all rights to the child as if he/she were born to you.

    Hope this helps.

  3. You need a lawyer to give you the best advice on the differences...they are legal terms.  There are different types of guardianship, for example.

    Good luck!

  4. Dear William,

There are several differences between them and even more in their subcategories.

Guardianship means a one person has "authority" over and/or responsibility for another person. It can be a minor or an adult. It is usually done between consenting parties and does not change any of the ward's (person being "guarded")official paperwork. It is usually inexpensive and can be often be done quickly and with little paperwork or preparation. I does not usually require the involvement of the Court. It can be permanent or temporary. There are several types of guardianship: Kinship, emergency, adult (cases of mental,  physical, medical or legal need), ad Litem ("at law" for legal representation usually limited to one particular proceeding) and estate.

Adoption is a permanent placement of a child which in effect makes them legally "as born to". It is complicated, expensive in some cases, and legally "erases" the child's history, biology and relationship to his or her original parents (as if they never existed). It must involve the Court. Names and original birth records are often changed or altered and the original information is sealed. It is essentially taking someone out of one family and placing them in another in the eyes of the law and society. Current laws deny adoptees the same rights to their documents and history than the average citizen - even as adults.

There are kinship adoptions - with a family member

closed adoptions - no contact at all

semi-open adoptions - the first family & adoptive family have some communication

open adoptions - there is more contact but is NOT enforcable and can be made "closed" or "semi-open" at anytime by any party

adult adoption - between consenting adults

Custody simply refers to the division (or not) of reponsibilies, time and practicalrelationship between a minor and his or her parents, guardian, caretaker or whatever. There are several types of custody: full, sole, co, shared, partial, temporary etc. Wiki has a pretty good explaination of how this stuff works.

These are all very brief descriptions and I would advise you research them all further for a better understanding of their meanings and applications but I hope this helps clarify them a little for you. Happy learning!

  5. Adoption – is where a person is legally adopted and most of the time their surname will change to that of their adoptive parent(s). The adoptee is issued a new birth certificate with their adoptive parents name on it.  One example would be Dean Cain who was adopted by his step father Christopher Cain, prior to that his surname was Tanaka

Guardianship- Are the people who take care of and have legal custody of a minor when the minor’s parents have died or are unable to care for the child. The minor is under the care but retains their birthsurname.  An example of this would be if we look at the Harry Potter books Harry lives with his aunt and uncle and they are his guardians  their the ones that have to sign any permission slips he needs , responsible for his well being such taking him to doctors appointments etc, but he does not become Harry Dursely.

In some cases one can have  temporary guardianship until the child(ren) parent(s) are able to care for them again or other arrangements are made
