Disability ratings with workmans comp?

How is your monetary award figured from your disability rating. My husband was given a 5% perm. disability rating. His monthly salary is $1500. Does he get compensation for the rest of his life or a set amout of years. Sorry, its just that we are not getting help from his case worker. She told us we will just receive a check and thats it.

  1. They figure out the loss of future earnings, until he's 65.  Compensation duration varies by state - and his age.  If he's 64, you're not going to see much at all.  Some states pay out until 65, or settle lump sum for that amount.  Some limit payout to 5, 3, or 2 years.  

    So no one here can answer that.  We don't have enough information.


  2. It depends on some states, most of the states I've worked on is based on the highest average weekly wage available multiplied by weeks or percentages.

    In your case, since there isn't a lot of info your husband will get either a lump sum value or payments depending on the state rules.  It won't be a life time payout unless your husband is totally disabled from the injury, meaning he has to be a quadriplegic, brain damage, all limbs have been amputated, or death...very drastic injuries
