Question:

Discovercard just sent me an INTENT TO SUE letter. What should I do if I don't have a job?

I called them, trying to explain my situation, & the man was very hostile & abusive @ 1st but then turned out to be a little nicer, but he said he can't accept a small amount of $$. I'm disabled & receive SSI & Social Security. Only $657/mo. total. My rent is 1/2 of that. 3 & 4 yrs. ago, I was making ALL payments on time until Hurricane Katrina. I have been stuck & struggling ever since, trying to replace my losses. & he tried to say Hurricane Katrina was my fault. No one cares. They don't care if I'm struggling for survival & DYING!

I'm willing to pay all the & student loans I owe, but no one wants to hire me because I appear to be mentally "slow" to them. I suffer Tourette's, OCD, anxiety, & depression, & I'm about to have a panic attack, & tears are starting run down my face.

  1. They have no right to hassle you like that. Be persistent, I know you feel like you can't handle this but if you can do it now, you'll be so much better off.

    Ask to speak to a manager and explain the situation. He wont be happy -but that's ok. His job is to get some money out of you so be strong. You need to come to some arrangement with him. That might be a part payment, where they cancel some of the debt as they realise they're just got going to get anywhere, and a new payment plan.

    You need to work out what you CAN afford to pay them every month then tell them that. Be reasonable and make sure you can still eat and pay rent etc.

    Stick with it. If they're not happy, make sure your offer is on their file. Keep calling back and making the offer. They'll just keep calling you anyway and it will stress you out.

    But remember you need to come to some solution with them otherwise it's more hassle than it's worth. You could go to Court, but it's not worth it if you'll be more stressed.

    Can you talk to a friend about this and get their help in making the calls?


  2. Have you considered bankruptcy protection?  It will make your credit bad, but at least the creditors will have to stop bothering you.

  3. They can't touch your ssi or social security.  I would call them and ask for a manager--you do not have to take someone abusing you.  Apparently if you are renting, you have no assets.  They can cancel the potential legal action--this is just a letter advising you what their intentions are.  They can take information from you--your debt to income ratio--and put you on a hardship program.  Good Luck!!!

  4. let them sue you-- you'll go to court, present your case, show the judge you income vs. liabilities--  they cannot get blood from a stone--  they may award judgement to the card company, but may not garnish any of your income--   depends on how much you owe as well--  if its over several thousand dollars, they may suggest a Bankruptcy to dismiss all your creditors

  5. don't let them know that you have a steady income. They can sue and garnish your wages and take up to 1/4 of your salary. Tell them that your wages are spotty and that you're looking for steady work.

    Also, you can "settle" the debt. They will settle for up to 1/2 the total. Tell them that's what you want to do...if you can afford it naturally.
