Disorderly Conduct charge??

August 19th I went with my boyfriend (of 6 months) to pick up his daughter for visitation at his soon to be ex wife's house. Well when we got there she started calling me names Like *****, you know.. So I got out of the car and was walking up the stairs and she pushed me. So I got up and then she started pulling my hair so I started pulling her hair and I punched her in the mouth and busted her lip and she was bleeding pretty bad. We were fighting for about 1 min. or 2 Scratching, pulling hair slapping. You know the deal. lol She left 3 small bruises on my arm from when she pushed me. Well after the fight was over we left and called the cops. When the cops got to the gas station were me and my boyfriend was I told him my story and he wanted us to go back to her house where it happened at so he could get her story. Well of course she said I hit her first. (I didn't) and her boyfriend said I punched her first too. My boy saw everything and he told the cops that the only reason I even hit her was b/c she pushed me first. At first the cops said that we wouldnt go to jail but like 20 mins. l8er I seen her in handcuff and then the other cop came to my car and told me to get out and put me and her in the same car... The cop said that we were both going to jail for Disorderly Conduct..... I got bailed out at 12 a.m. ( I was only on there for 6 hours.

Anyways, my question is... Will I go back to jail for this charge or will I get probation or cummiunty service or something?? I have court Nov. 4th.

  1. The problem is you was on her property, meaning she didn't come to you looking for a fight.  Ex wives and girlfriends very seldom get along. You should have just ignored her and stayed in the car.  Calling the police after the fight was a mistake.  Here's what will happen...You will go before the judge, he will ask how you plea, then he will probably give you a fine, community service and you will be on probation for a year, and he will probably order you to take Anger Management Classes.

    This is going to be quite expensive and I hope she didn't go to the Dr. and run up alot of medical bills because you will have to pay them too.  Good Luck


  2. GET AN ATTORNEY.  If you were going to a foreign country you would want a translator and court is like another planet sometimes.  For what it's worth,  don't get out of the car next time.  Better yet, wait at the gas station.  The cops don't want to get involved in she-said /she-

    said.   Arrest everyone and let the judge sort it out.

The worst most likely would community service if a first time offense and a fine.  Sounds like she wouldn't let it go and said she wanted to press charges so the police ended up arresting both of you since no proof who did what first.  They will some times do that to try to get the person to back off.  

  4. The jails are full so they will give you maybe 30 days suspended sentence. Good for you on sticking up for your self.

Above posters are correct and telling you to get an attorney and as you went to her place before the divorce was even final with her husband and got out of the car and actually hit her first (even though you indicate she pushed you, she didn't strike you), you are not likely going to win if it goes to Court.  

    If she presses charges and the D.A. wants to pursue it, you could be charged with assault and battery and tresspassing.

    As it is your first offense, you are not likely to do any jail time, but even Disorderly Conduct is a misdemeanor and it can affect your ability to get a job in the future.  

    A good attorney may be able to plead it down to a lesser charge and have deferred adjudication in exchange for paying the fines, Court Costs, Probation fees and likely will have to attend some sort of anger management program, but once you complete all that is necessary, the charges will go away although an arrest will turn up on some searches, a conviction will not.

    In the meantime, don't go with your boyfriend to pick up his daughter, let him deal with his ex on his own.
