Disputing Total Loss Car Estimate w/Insurance???

I recently got into a nasty car accident in which my car was deemed a total loss on site. I have received the police report and clearly the other party is at fault (3 witness statements are included as well!), so i am pursuing damages through the other parties carrier. I used to drive a 2003 Honda Civic EX Coupe clearly worth $10,000 in excellent condition according to nada.com and kellybluebook, even at 99,000 miles. Now, my car was in good condition and I do have maintenance receipts, but my insurance provider is only offering $5,181.00--Is there anything I can do to go about disputing this claim? This is WAY below what I expected to receive and this whole process is becoming very frustrating as I had planned on keeping that car as long as possible.

  1. clearly no one here know how a total loss works......the ins company will give you the private party/trade in value...they are not going to give you retail because you can find the exact year/make/model with less mileage for around 4895.00......it is NOT, I REPEAT NOT, RETAIL VALUE......

    use kbb.com for trade in or private party value and you will see.....your car is worth 10,000 MAYBE, and i mean maybe, at a dealership....because of all the hidden fees and expenses a dealership goes through to market, repair, detail, maintain, and finally sell the vehicle......

    basically, use trade in not full retail.......oh if you notice on kbb.....retail only lists excellent condition values so i dunno how you got one for a "good" honda......
