Divorce for under a year of marriage in Australia?

I left my husband after under a year of marriage, It has now been 12 months since the separation and I am eligible to file for divorce however was told today that if you have been married for under 3 years you need to have court mandated therapy!

Can this be avoided?

  2. No I don't think so.  A lot of changes have happened in family law in the last couple of years.  I do know that you will be required to attend mediation before the divorce hearing.

    Don't fret - they can't force you to get back together!  If you have split due to abuse, then you can state that you fear for your safety in being in the same room as him, and they are able to make allowances for this, however you will still be required to attend some form of counselling/mediation.
