Divorced in Nebraska but want to remarry in South Carolina?

I am divorced in Nebraska but in the decree it states that I can not remarry for 180 after the divorce is final. I want to remarry in South Carolina which has no waiting period after divorce. Can I remarry during this 180 day period or would the marriage be void?

You might be able to remarry in South Carolina, it all depends on whether S.C. recognizes the 180 day waiting period in Nebraska.  I would suggest you contact a magistrates office in S.C. to find out for sure.  You can get the magistrate's office number by calling information in the county in which you plan to marry.  Good luck.

I'm pretty sure the 180 day limitation will stay in place.  One of the things about the constitution is that it says each state needs to accept and enforce the other state's laws.  This is particularly important with marriage laws, since they do vary significantly from state to state, but the legality applies within the country as a whole.

    Your best bet is going to be to call the county clerk where you want to get married, and ask.  Or, you could just wait...it's not like it's that long, after all.

  3. You know I have never heard of this law to wait 6 months to remarry. But I think it's a great one. It would slow most people down from hopping from one marriage straight into another, or possibly trading up one spouse.

    I think it's a great idea. Whats the hurry to remarry? And how can you be married to one person and IMMEDIATELY following the divorce hop right into another?
