I WAS ARRESTED FOR DUI A FEW MONTHS BACK,AND I HAD MY APS HEARING AT THE DMV LAST WEEK ,AND I ACTUALLY WON THE HEARING,WHICH SUPRISED ME BECAUSE I HAVE BEEN TOLD THAT ONLY 8 PERCENT EVER WIN THESE HEARINGS.SO IM STILL DEALING WTH THE CRIMINAL PART OF MY CASE THOUGH,AND THE DISTICT ATTORNEYS HAS OFFERED ME A WET RECKLESS INSTEAD OF A FULL BLOWN DUI,SO MY ?IS SINCE I WON AT THE DMV HEARING AND I TAKE A LESSER CHARGE IN THE CRIMINAL COURT WILL THE DMV SUSPEND MY DRIVERS LISENCE?

  1. The DMV will only suspend your driver license based on points. A reckless driving conviction will give you 6 points, doesn't matter what category of reckless driving, they are all 6 points. So you are ok with the DMV unless if you already have too many points.  BTW, DUI is also 6 points.  Points wise DMV will give you 6 whether or not it is DUI or reckless driving.  http://www.dmv.virginia.gov/webdoc/citizen/drivers/points_6.asp

    It is a very good possibility that the court will suspend your drivers license as part of your sentence.  If you made a plea deal, it would not surprise me that a license suspension is included. The longest the court can suspend your license for reckless driving is 6 months which is a lot better than 1 year for a 1st offense DUI.


  2. Dealing with this same issue myself. Just won the DMV hearing today... you want a "dry wreckless", not "wet"... if anything, but as far as I can tell, the DMV is not connected to the criminal aspect.
