I and my ex bf planned to travel for a week vacation in september. I paid for the flight tickets. He later asked me to change the dates which cost another $200 change fee. He agreed to take care of the change fee in addition to his share of the cost of the ticket which he was supposed to pay in a week's time.

We broke up a few weeks later, then he decided that he was not travelling. He still has not paid. I have given him two weeks to pay up or I go to court. If i take this before a judge, do i have a chance to win the case. I want to consider my options.

I don't mind getting back the previous change and future change fee for his ticket because i could get ticket credit from the airline. advice please.

  1. try small claim court for getting the money back

  2. Do you have the agreement in writing or a witness to his statements?

  3. you have a chance make sure you go into court prepared, have your receipts and any other evidence that might help your case. he might try to Deny ever agreeing to the trip or to pay his share so try to get witnesses or better yet a tape of him implying himself.

  4. Unless your agreement was written or spoken with witnesses, then it is not binding and will not stand up in court.

  5. I'm not a lawyer but I see something here others have said about your case.  What I have seen is that in this type of case a judge would have to make a decision base on a preponderance of the evidence.  Preponderance would be the weighing of human nature and other factors to determine which party in the case is telling the truth.  You have look at how you could tell your story so a judge can make a determination.  You would probably need witnesses to show what your relationship and intentions were.  Meaning you and him.
