Question:

Do I have a choice to be with my mom ONLY?

I'm 14 years old, and possibly in the coming year or around Winter 2010 my mom and I want to move out of the country.

First she needs full custody of me, but don't I have the choice at this age to be with my mom all the time if I want?

And also, I REALLY want to move out of the country. It's mostly my choice. And I'm pretty sure my dad would approve anyway.

But really, do I have the choice to be with my mom only now?

  1. not sure where you live butin usa it's usually 12 or14 is the age you can decide. If you told a judge that's what you wanted to do I'm pretty sure he would grant it.you'll hafta go back to court.

  2. all you can do is go infront of a judge and request it or your dad would have to go in front of the judge and sign his rights over to your mom giving her full custody

  3. I am really not sure about the age , I thought it was 16 , but again I am not sure . The best thing would be to look it up in the law books at the library or ask someone in a higher position like a judge or something .

  4. I think you can make that decision, but you must present it to a judge and he'll want to ask questions,so he can decide wether it's is what's called: "in the child's best interest." in the case that you want to live entirely with your mom.. But if he gives your mom child support that might be cut off and some other things like medical insurance. That's the money she usually receives to help care for you and see that you have food and clothing.
