Do I have a legal case against Chevrolet?

I was in an accident in December - I rear-ended someone while doing about 40 mph. My car has been declared a complete loss. According to Chevy, the airbags will go off if travelling 15 mph or faster, however, mine never deployed to the amazement of the responding police officer and tow truck driver...

    If you are okay then I would say that your chances are 50/50 that you will win any type of law suit.

Most air bag systems can be accidentally prevented from going off for a variety of reasons, such as not stepping on the brakes before impact, as well as flaws in the air bag system. You would have to prove that they failed through a negligent action on GM's part.

  14. No. It would have to be investigate professionally, but to my knowledge of cars, ex car salesman, You have to hit certain sensors at  certain angles to have the airbags deploy properly. I  T-boned a lady with a brand new altima at 40 mph, Air bag never deployed and I had a knot on my head from the darn wheel. So it would probably be hard for tyou to have a strong case. unless there was a professional investigation and it was deemed faulty of the manufacturer.

These manufacturers have spent millions of dollars on research and other safety data and specifications. They also pay top dollar for legal representation to back up any claims of their safety and specifications. Every person who is injured in a car crash can point to specific items that did or didn't happen and sue whomever they want. In the end, it comes down to money and representation. For these corporate giants, it's mere pocket money. My advice would be too get all the facts, weather conditions, damage, check manufacturers recalls in case there was a recall on your vehicle for airbag deployment (in a lot of vehicles, especially minivans there are frequent dealer recalls who are supposed to inform the customer to have their airbag sensor fixed). Only after all this has been done should you contact a lawyer. Your lawyer may in turn contact them and set up a hearing in court or it may be settled privately. Whichever, the case it will not be a quick and decisive settlement. They will investigate it too as their livelihoods depend on it and they are not mom and pop stores or fly by night operations. These manufacturers have been around for 80 years.Anyways good luck.

    Was the other car standing still?  A lot depends on the exact angle of impact, among other factors.  But there is no guarantee.  Especially if you were at fault for the accident.  Had you been driving safely, they would argue, it wouldn't have mattered if it went off or not.

  20. How do you know that you were doing 40? In order to file suit you would have to show that you suffered harm. The loss of your car is not considered harm. Was there any personal injury to you that was substantial? Even if you did file the case, you would have to prove that you maintained the car in every way possible. The accident was your fault too and this would figure into the case.

The easy way to figure this out is to contact a lawyer.  All you have to do is find a local lawyer that does not charge for a consultation.  If you want, ask them first.  Also try to find a lawyer that will only collect if you win the case.  Believe it or not, there are plenty of lawyers out there that operate this way...and if you are unsure of a case, a lawyer will simply tell you yes or no.

  24. My wife totalled a 2004 Chrysler van and the airbags did not deploy. You could file suit but it would be VERY expensive and you probably would not win.

  29. how badly were you hurt? were you wearing your seat belt? was the car new? has it ever been in an accident before? was the srs light illuminated? if so the air bags would not deploy because of a problem in the system. and yes the angle of impact does have something to do with it.
