Do I have any legal leverage concerning this auto accident?

Florida:

My fiancé and I are in the middle lane with our right turn signal on. As we turn into the right lane a vehicle turning right out of a restaurant parking lot collides with us. We do not call the police and exchange information with the other driver. Upon speaking with the other driver the next day I am told that he had obtained two written eye-witness reports taken by 1. his roommate and 2. his roommate's girlfriend who was behind him at the restaurant. There account of the story goes as follows:

As the other driver pulled out we allegedly crossed three lanes (most likely in order to turn into an establishment) cutting him off. He was already completely pulled out and in his lane.

The other driver suggested that we both take care of our own damage and call it even.

This was six months ago. Due to other complication in my life such as hospitalization and marriage, I did not contact him again until today. He has never admitted to anything. Do I have a case against him?

  1. Talk to a lawyer.  Random people on the Internet are a poor resource for legal advice.


  2. Talk to an attorney. Like the previous poster said, random people on the internet are a terrible source of legal advice. Never leave an accident without a police report.

  3. Yes you do. There is a statute of limitations (2 years in CA) to file against him

  4. you need to get professional legal advise anything on here is going to be purely opinion base

    but for future accidents always trade out information and if possible get a police report will save heartache in the long run as you are currently dealing with

  5. You can try speaking with a lawyer but he has the witnesses and there was no police report so I would say that you will loose, sorry.....

As far as I know the first person to enter the lane has right of way.  Considering his witnesses are personal relationships I doubt they will hold up to anything.  I believe the Florida No Fault law will have each of you taking care of your own damage anyway.  I think neither of you have a case worth chasing after but it depends on your lawyer.  The cost of court and lawyer fees will probably more expensive than the damage unless you were driving an Enzo.
