Question:

Do I have any recourse against my Realtor?

She "forgot" to give our Counter-Offer to our Buyers ... we've been waiting over a week for their response to OUR last offer. She emails me and says "they are still interested ... but I'm not sure for how long" (hinting to us that it's time FOR US to do something). SIDE NOTE: She is not their agent ... she was initially ... but she gave it to someone else in her office (because of the conflict). But she still keeps us posted on their side of the story. Another SERIOUS BOO BOO on her part!!! I can't believe she dropped the ball on this. We could have lost these buyers! We've also had other issues with her (not as serious as this). Is there anything we can do??? We've only been listed with her for less than 3 Weeks.

  1. Terminate the listing agreement, that will take care of your relationship with the realtor.

On another note, don't sell to the same buyer you are dealing with now or any other buyer that the Realtor has shown the house to. That could trigger original agreement performance.

  2. You can call and talk to the broker.  If you really don't want to work with this woman but have signed a contract with the buyers then ask the broker to handle everything through closing.
