Do I have legal options to sue?

Rented truck to move the engine light was on and branch owner knew this but claimed no problems with vehicle operation. As it turns out the light came on because a filter needed to be changed which prevented truck from accelerating came close 2 being killed as I accessed major highway. The vehicle would not accelerate to even 80 kph. There was no manual in truck. Does anyone know if I have legal alternatives. I'd like to take this company to court so this doesn't happen to someone else under Duty of Care, Due Diligence, Reckless Endangerment.

  1. I doubt it, what does your contract say? Usually vehicles are rented "as is" and you have little recourse in a situation like this. Especially since you appear to have suffered no actual damages, I mean, what are you suing to be compensated for? Basically you are claiming they lied to you and gave you a crappy truck. It may be infuriating, but people are not obligated to provide good service to their customers. Rent your vehicles elsewhere in the future.  


  2. No loss, no real case. It would be different if you had been in an accident because of it.
