If there are two names on a car title can the main person sign the title over to the co-buyer? My grandmother is the buyer and I am the co-buyer of the vehicle, I have the car and make all the payments. She is going to be filing for bankruptcy and i am afraid of losing the car? Can they take the car or do I have rights since I am the co-buyer and the second name on the title? My grandmother also has her own car so Im afraid they wont let her keep both even though I have proof we make all payments on the one vehicle.

  1. ~~She has to list the car since it is a debt, however she does not have to list it as a debt she is wanting dismissal on. As long as you are making the payments there will be no problem. You may want to have a years worth of cancelled checks or receipts showing you were making the payment. Her attorney will advise her on that. Under the new laws proof has to be shown to the court she can make the payments before they let her keep anything. They will just make her aware she can never default on the loan once her bankruptcy is granted. With proof she is just a cosigner for you, I see no problems with you being able to keep the car.~~
