Do I have the right to read my just-deceased dad's will? ?

Step sister (daughter of my dad and step mother) refuses. She is executor. Step mom has Alzheimer's and tried to choke my dad so she is in an institution. Step sister claims I nor my 2 siblings have any rights. State: Florida

She won't even call any of us or tell us anything.

  2. His lawyer or whoever prepared it can let you know about that. Get a hold of them. They may be allowed to read it to you. Especially if you feel your sister is holding out on you.

Well, depends if you're legally allowed to or not.   Usually, if she's the executor and she claims u guys have no rights, then you CANNOT read it, but what you can do is, get a lawyer, and ask for advice to PROVE that she states that u guys dont have rights, or that u cant read it, and if she's lying,

    you can press charges against her, and that will make her look VERY bad, and you can win alot in that case :-D

  8. When my brother in law pulled this on my hubby, about their mother, we did go to a lawyer.  The BIL would not allow his lawyer to send hubby a copy until the same time that he was forced to file it for probate.  Then our lawyer got a copy, which was forwarded to us.  

    Found out there was a good reason for the secrecy.  MIL had Alzheimer's and had signed a will after the fact everything to BIL.  She had the 2 sons still living and no significant family squabbles.  My husband had done without for years to help her and farmed the family homestead for practically nothing.  Husband wanted to contest it, but being a former legal secretary, I stopped him.  It would have wound up costing more than it was worth.

    They have to file the will in order to probate it.  Wait until it shows up at the courthouse and then go make all the copies you want.  If it's worth hiring a lawyer at that point, do so  

  9. Absolutely get an attorney.  That will has to be made available or read.  As executor she is responsible for doing as it says  that does not mean she gets it all.  All family members have the right to know what is in the will.  Be sure it is checked for authenticity.

    And you are all blood related to him  that is she is a half sister,  same father different mothers.

    Is she executor of her mothers estate?  this may be where she gets that you don't get anything.  His wife would normally get everything if there was no will to say otherwise.  But I would really check that will She is hiding something or she would not have any problem showing it.  Check probate laws,  estate laws,  Wills   GET AN ATTORNEY
