Do I have to ask my ex for permission to move if...?

If my consent order for custody (we've reached an agreement outside of court between our lawyers, and we both signed it and the judge too) states that the father has to pick up and drop-off my child at my home, as his own cost, anywhere I may live within the province (we're in Canada, but if I were in the USA it would be like anywhere I may live within the state), and that if I wish to move outside the province, and can't reach an agreement for access with my ex, then I'd have to ask the court to decide... Does that mean, because my ex signed the papers with that on it, that I can move WITHIN the province, without having to ask for his permission or without having to go through the court? Does that imply that?

  1. Sounds to me that you can move anywhere in the province without any ones permission.


  2. In Michigan we have a mile limit say 50 miles unless both parties agree on something different. The reason for the benefit of the children having both parents involved in their life.

  3. Sounds like you can move anywhere you want within the province.

Sounds like it is OK however you should mention it to your ex since it will impact him.  If you are moving within the province but quite a distance from him it will reduce his access to see his child as he will have to spend time travelling.  If you are living close by now and he can see the child on a regular basis (weekdays/weeknds) and you have decided to move much farther he may not agree to that.  He does have the right to have access to his child.  If he agrees then great, if not, you should seek legal counsel.

  5. I would assume that is exactly what that means that you can move anywhere WITHIN the province without having to ask his permission cause it does state that in so many words.But just to be safe I would ask a lawyer to make sure that you are understanding this correctly.Good luck.

  6. Yes that is exactly what it says. Anywhere in the province. I don't think you could move to the United States with out going to court but then you would be in a different country and Canada laws would not apply here.
