Do I have to file a travel permit together with I-751? thanks for anyone who can help.

My card expires in Nov and I have to go out of the country in Dec... do I also need to file a travel permit when I file for I-751 (removal of condition of residence) to be sure that I will be allowed to re-enter the US after my 45-day vacation?

  1. No, you don't. If you file your I-751 90 days before your green card expires, you should receive an acknowledgment receipt from CIS. That receipt will extend the validity period of your card for one year.

    The combination of the card and the Notice of Action receipt will permit you to return to the U.S. after a 45 day trip. You do not need anything else.

    The reference is 8 CFR 211.1(a)(5) "An expired Form I-551, Permanent Resident Card, accompanied by a filing receipt....."
