Do I have to give a notice before I quit my job by law?

I have been working at this restaurant for several years and have been fed up with the way things are there for a very long time,so the other day I just told the managr im leaving ,and I went home.I called the next day to apologize for leaving like that and that if he needed me to work some hours for a week or so I could,He said no I dont need you,so now I have to talk to the owner so is that I can pick up my last pay and my 4 percent,Can he refuse to pay me what he owes me because I did not give a notice?

  1. Nope. Unless you signed a contract stating otherwise, he's gotta pay up.


  2. It depends what it says on your contract. If there is no contract then he (employer) can do anything!

    If there is a contract and you can prove you worked then he has to pay you. If either of these are missing then you will have ask (nicely!!).

    If he knows you can't prove that you've worked for the time you are owed then you have a problem.

    You can sue but it probably wouldn't be worth it.

    My advice: go back (when he's not busy) say you regret that you walked out like that and that you understand he doesn't want you back but that that you really need the money for the time you've worked.

  4. No, he cannot.  It is not illegal to quit without notice.  It is just considered curteous to give a two-week notice and it increases your chances of getting another job at the place should you ever need to.  It is a way of not burning a bridge.

    However, there are some times when burning bridges is the only way to get ahead.  For example, I work for a retail store right now but if I got a call tomorrow with an offer for a Graphic Design position, I'd be quitting in a heartbeat!
