Do I have to plead guilty to a crime I don't remember? I was charge with DWI for driving a car through a 7-11?

All I know that I woke up in jail the next evening and I don't trust the police especially when they tell me my BAT was .41

  1. You don't have to plead guilty to ANY crime. You can take it to court, plead not guilty....be found guilty and have a stiffer sentence. It's your choice.


  2. You know that when you opt for a trial instead of pleading out, you are costing taxpayers money, who do you think pays for the trial? Your lucky you didnt kill anyone, And sorry to inform you that with that BAL the charge will be upped to aggravated DUI and you could see jail time. This will also end up costing you about 6-8,000$ in fines costs and reinstatement fees. Not to mention the restitution bill for turning 7-11 into a drive through. Hope the buzz was worth it mighty expensive booze. Hope ya learn something from Victims Impact Panel and DUI school, it may save your or someone elses life. Good luck

  4. You was still driving drunk. That's enough to get a good punishment. I can't stand drunk drivers. They have no business even having a liscense.

  6. If your B.A.C. was .41, your lucky you didn't die because many do with that high of an alcohol level as their respiratory systems shut down... (not to mention the risk to you and others you took while driving in that condition).

    Talk with attorney and stretch it out for a period of time if you like but it's likely there will be a price to pay no matter what you choose.

    It might be wise for you to learn to accept responsibility for your own actions rather than to point fingers at the cops you don't trust because they may have saved you and someone else's life that day.

  7. You can go to trial with it. But I'm guessing they have a whole lot of evidence against you whether you remember it or not. Just the fact that you did this and don't remember means that you should go to jail for as long as they can keep you.

  8. No, you can plead not guilty and have a trial. I would think you would be better off pleading guilty though.  With a BAC of .41, hopefully you will get some jail time. I would hate to think what the restitution is going to be to 7-11. I assume it will be hard for you to get insurance in the future.

  9. DWI is not a game you could go to jail for long time and this also effect whole your life. So get a good lawyer and let him do his work.

    Being so drunk you cannot recall is no exuse.

    You could have killed someone you fool! Could have been a child!

    You showed no respect for others as most drunk drivers!

    I would give you 5 years in prison as our DUI or DWI laws are to soft!

    At least get you off the road.
