Do I legally have to pay this early termination fee? (minor)?

Here's the story. I tried getting a phone under my name last Nov. I was 17 at the time, so I wasn't able to, but then about a week later a lady from the same store told me that they could just say I was 18 and I would be able to get the phone. It was a T-mobile flexpay account, which normally don't have contracts, and you pay the bill ahead of time. I used the phone up until about June, when I lost my phone. I didn't pay the bill for July or August because I didnt have a phone and I didnt know I was on a contract, so I figured it would just end. Then I just got a bill in the mail charging me a 200 dollar early termination fee. Im about to start college so I dont have money to throw away like that. Ill be 18 on the 6th of September. So my question is would I still have to pay the contract cancellation fee if I let T-mobile know that it was a minor on the contract?

  1. It will go on your credit, you may be able to go back to the store and tell the manager someone told you to say that and they may waive it.  I think they are supposed to check your credit and your license but I do know any legal info.  I'll bet if your Mom went in there she might be mad but she would take care of it.
