yes, children must be strapped in a car seat by law. I assume you will be able to hire one from the car hire company , but make sure you arrange that beforehand. If they don't have any, you will need to make your own arrangements, but you MUST have one, especially the way they drive here.

Regardless of where you are, a 5 year old child needs to be either in a 5 point harness forward facing seat, or at the very least, in a high back booster seat. Yes, laws change depending upon where you are, but the laws of physics are the same everywhere. He will be just as hurt in Spain as wherever you are now.
