Do I need permission from baby's dad to leave the country? We're not married...

My baby's dad and I are not married (or together at all for that matter) and I might be leaving the country for a while and have a one-way ticket. We agreed not to go through the courts for some reasons so we have no custody agreement but I am the sole caregiver for the baby. Will I need a notarized letter from him when I leave the country or can I just leave without it?

If there is no court orders  GO!!  If he finds out you are leaving with his child he can go to the court get a emergency hearing and stop you from going,  Did you put the fathers name on the child's birth certificate?  if not you will need nothing.  if you did and he finds out he can put kidnapping out on you, and they will arrest you trying to leave the country with the child. I don't believe you will need any thing to leave the country with your child as long as you can prove you are the child's mother.  Do not tell any one you are going and just go.

    be prepared to explain later in your child's life why you took them from their father.  most likely the child will resent you for doing this when the child is older.

  4. Go! But don't be like my mom and never let me meet my dad. Make sure you keep in touch with him. For the childs sake.

  5. for just a vacation you can leave but should notify him, if your going to move and be gone for months then in western world, since he have visitation rigth he can report you for kidnaping and breaking his visitation rigths

    talk to him, if he fine with it then you dont need a letter, however leaving without him knowing for a length of time can cause you problems (even if your primary caregiver he have the rigth to see the kid)

    and also in most western countries as said above, you normaly need both parents signature to get a passport (which you will need to take the kid out of there)

  7. In the US. you need official consent to leave the country with the child.  You may even need to have the father present when you get the passport.

  8. I don't think its a legality concern but rather to get a letter to keep things right between you two. I would do it to get him to see you care about his place with your child. You could be gone and he could file a custody battle against you. Besides, I would want paperwk to give me rights when you move.

  9. u won't need a need a notarized letter from him but tink about it... how would u feel if the baby's daddy is the sole caregiver for the baby and he leaves the country wif a one way ticket without telling u?

  10. If you care about your baby and its relationship with its dad at all, you would get full permission before leaving.

    If the dad finds out that you are leaving against his wishes or knowledge, he can take you to court and get a legalized visitation order and make it where you can not leave the country at all. IF he chooses to do so, that is.

    EDIT: I would check into that-

    Was your baby born in America? He may be able to get a court order for HIS (and  your) child to stay in the USA but you are free to go because you are not American.

    Would you go without your baby and give custody rights to him?

  11. i think you better get in touch with an attorney..even though you guys decided not to get the courts involved so far since you have an one way ticket out of the country it might b in your best interest to ask an attorney what you should do...
