Do I need to apply for I-485 within 90days before my visa expires or apply it later?

I was admitted to the USA as K-1 fiance, me & my fiance got married on the same day of my arrival. Do I need to apply for I-485 within 90days before my visa expires or we can do apply later?

  1. There is no legal requirement for you to adjust your status within 90 days, you are only legally required to get married within 90 days.

    Obviously filing for AOS is better sooner than later, but you are under no obligation to do so within any time-frame, just so long as it is reasonable.


  2. My wife is from Russia and I went through an attorney. They told me to file her adjustment of status within 30 days of our wedding date. The process took almost 8 months to get her grren card.

  3. Well, since you're already married to U.S citizen you could file the i-485 whenever you want.  However, it would be much easier for you to do it before your visa expires since you will basically be an illegal immigrant when it does.  

    Again, you don't have to file it now, but you should.

  4. You have to get married (which you did) within 90 days of arriving.  In my opinion I would apply for the I-485 now because it take over 180 days for the approval.  And you can't work until they send you a work visa.  You will apply for a work visa and travel document when applying for the I-484 it's around $1000. Good luck and do everything by the book or else your going to hate it, I know I married a Brit and had to go through all of this, sent in the I-485 October of last year and still havn't heard anything although he did get his work visa and travel doc within 3 months good luck
