Do I need to clean house that I rent which is being foreclosed?

I am renting a house which the lease ends in December. It is being foreclosed on in 2 weeks. I spoke with the real estate agency and they said that I will get my security deposit back, along with my last months rent (which will actually be next months, I'm still suppose to pay). We spoke with a lawyer regarding this. Am I then obligated to fully clean the house when I leave? In the lease I was suppose to have the carpets professionally cleaned, but that is null and void then right, once the house has a new owner?

  1. If you want the security deposit back...follow what the lease states.

    EDIT:  Don't count on your security deposit from the real estate co.  They will do an inspection of the property when you leave and if they find any damages or the property is dirty, they WILL deduct the costs from your deposit.  Even though your lease will become void...you will still be under state laws for Landlord/Tenants.


  2. just because the house is being foreclosed on doesn't mean you don't have to clean it. the bank can charge you for any cleaning they have to do in order to sell the house.

In all honesty I'm not entirely sure, but it seems to me that if the contract becomes null and void then you don't have to oblige to anything agreed to in it.  A previous question on this site asked if the bank could evict you once they foreclosed on a house you were renting and most people seemed to think yes they could since the contract no longer exists--I would assume the same applies here.  I would get your deposit back, move and then see what happens from there.  The bank won't be able to produce any contract you've signed with them since one doesn't exist so they can't really charge you anything based on that.  From my experience banks usually don't even see the houses they are selling anyway.  They are all sold "as is" and go through a seperate broker.
