Do Intra-Family adoptions still recieve child support?

Man A and Woman A were married and had a child. Now Woman A is married to Man B. If Man B adopts the child does Man A still have the responsibility to pay child support?

  1. It depends on the situation. I have a cousin who had a child with her first husband and they divorced and he lost all rights to the child but still has to pay child support. This was set up by the court, not ask for by my cousin. Now her second husband has adopted the child and yes, first husband is still paying. Situation was extreme, he was stalking, threatening and abusive and that may be why the court set it up this way.The child has a perm-ant order of protection again est him and he is not to know where she is

    In order for Man B to adopt the child, Man A would have to sign over all of his parental rights and responsibilities.  Man B would have to assume those rights and responsibilities.

That is determined by the court at the time of the adoption.  If Man A is the biological father and agrees to terminate his rights then, NO his does not continue paying child support.  If Man A allows the child to be adopted do to reasons other than a desire to be out of the child's life then that depends.  My brother allowed his son to be adopted by a Man B.  but he did not terminate rights.  My brother was in the military and wanted my nephew to be able to have insurance under man B's names as he had a better policy.  There has never been a day that nephew and father ( my brother) have lost contact, and my brother continued to pay child support until he turned 22 and graduated from college.

  4. No, once the biological father releases parental rights of a child, he is no longer required to pay child support.  In order for the child to be adopted, the father has to relinquish parental rights.

  6. Yes Man A will have to pay, if there is a legal binding divorce decree that spells out child support payments, he will still have to pay.  The divorce decree will have to be amended,  Man A will have to give up parental rights to child in order to stop paying support

How it was explained to me by an attorney is if, man A willing gives up his parental rights then any back child support is forgiven and he is not responisble for any future support.  They do this as sort of an incentive to man A, so it doesn't become something long and drawn out.  Now if man A refuses and his rights have to be involentarly terminated the court may very well make him pay any back child support, just because he has already shown that he is irresponsible and has not acted in the best interest in the child

  8. if man A signs off all parental rights and man B adopts the child then man A does not exist in that child's life at all anymore and man B has all financial and emotional responsibilities

    When Man B adopts the child, he assumes all roles of the father including support until the child reaches the age of 18 (23 if a full time college student) even if Woman A and Man B get a divorce.

In order for an adoption to take place, Man A would need to terminate his parental rights, which includes financial obligations.  When Man B adopts the child, he takes all legal and financial responsibility for the child.  No child support would be involved unless Woman A and Man B divorce.  Man B is then required to pay child support.
