Question:

Do Ordinance violations ever come off your criminal record?

I got an operating while impaired in 2001, and I was wondering if it ever comes off my criminal record (the one employers see) My lawyer got it down to an ordinance violation, from a misdemeanor. I am in Michigan. I know that employers can see it, b/c a few yrs. ago I applied to the Post office and they background checked & it was brought up. Thanks,

  1. Hello Olivia. It is better to have an ordinance violation over a misdemeanor, but both of them will remain on your permanent record which will show up if an employer runs a background check.

Best advice is to contact your attorney again and ask him if you qualify for an expungement of that charge. The charge is very minor, but your city laws may vary, which is why I say to ask about yours. If so, the attorney can draw up the petition and submit it in your behalf. Once it goes through, it would be removed from all public viewing and background checks would then show nothing.

Best of luck and I hope this is useful to you
