Do UN obligations take precedence over constitution?

In the event of a conflict between the obligations of the Members of the United Nations under the present Charter and their obligations under any other international agreement, their obligations under the present Charter shall prevail.

That is what article 103 states^ but it makes no mention of domestic obligations such as our constitution...

  2. Legally, our Constitutional guarantees cannot be pre-empted by UN agreements,  but that hasn't stopped the globalists from working to negate our Bill of Rights to achieve Agenda 21.

  3. The very real and present danger is that neocons have infiltrated the Security Council of the UN and of course the US government. Since the US tends to veto most worthwhile UN resolutions the other countries would be glad to have the US gone. Isolated, the US would be impoverished. The real question is if the US will remove the Israel Advocates from its decision making positions and media positions.

UN obligations are obligations that have already been approved by our Congress, which means that they are contemporary to the Constitution, and have effect under the Constitution.

    The UN Charter does not set out actual obligations, it is a set of guidelines.

    Obligations must be explicit, the UN Charter rules (such as the Article 4 rules), make exception to member states. Basically if you are already in the presumption is that you follow all the rules.

    The UN is not allowed to supplant the sovereignty of nations, instead its laws are supplemental. Treaties through the UN have the effect of law in the nations that are signatories.

    Your question is too broad and vague, which under constitutional law we are going to say is struck down.

  7. The U.S. Constitution is not an international agreement (at least since the Civil War, but that's a different question) so it takes precedence over the U.N. charter.

    I am concerned that the U.N. is turning into a global government and I would like to see the U.S. withdraw and expel the HQ from NYC. I worry that some future Supreme Court will make U.N. law supreme to U.S. law. At that point we will lose our national sovereignty and our freedom.
